PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THE COLLECTOR CLUB, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE COLLECTOR CLUB TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED HEREIN BY REFERENCE, INCLUDING NEW ZEALAND MINT’S TERMS AND CONDITIONS AND PRIVACY POLICY.

IF YOU DO NOT AGREE TO ALL OF THESE COLLECTOR CLUB TERMS, PLEASE DO NOT PARTICIPATE IN THIS COLLECTOR CLUB, OR TERMINATE YOUR MEMBERSHIP, AS APPLICABLE.

1. ELIGIBILITY AND OVERVIEW

1.1 The New Zealand Mint Loyalty Program (the “Collector Club”) is offered only on www.nzmint.com, at the sole discretion of New Zealand Mint Ltd (“New Zealand Mint” or “we”). Your participation in the Collector Club is subject to all present and future New Zealand Mint terms and conditions, including the Collector Club Terms and Conditions (these “Collector Club Terms”). These Collector Club Terms do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services. Collector Club Terms are void to the extent prohibited by law.

1.2 Membership in the Collector Club is open to individuals for their personal use only and is limited to one (1) account per individual. You do not need to join the Collector Club in order to purchase products on www.nzmint.com. Corporations, associations, or other groups may not participate in the Collector Club. New Zealand Mint reserves the right at any time to limit the number of participants in the Collector Club.

1.3 By joining the Collector Club and becoming a Collector Club member (“Member” or “you”), you agree that you have read, understand, and agree to be bound by these Collector Club Terms and by any changes or modifications we may make. You should review these Collector Club Terms and the related COLLECTOR CLUB FAQ’S frequently in order to understand the terms and conditions that apply to the Collector Club, as these may change from time to time. Further by becoming a Member, you also agree to be bound by our website TERMS AND CONDITIONS and PRIVACY POLICY, all of which are incorporated herein by reference. For the avoidance of doubt, your continued participation in the Collector Club after any changes or modifications have been made to any of the Collector Club Terms constitutes your consent and agreement to be bound by such Collector Club Terms.

1.4 BizSpot members are not eligible for Collector Club benefits.

2. ENROLMENT

2.1 Eligible individuals may enrol in the Collector Club by using the launcher on the homepage at www.nzmint.com and following the prompts to join by creating an account. By creating an account, you are also creating an account for www.nzmint.com. Only one (1) account may be associated with a single email address. In the event of a dispute over ownership of an account, the Member will be deemed to be the authorized account holder of the email address submitted at the time he/she joined the Collector Club. For purposes of these Collector Club Terms, the “authorized account holder” is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

2.2 You may be required to provide your full name, email address and to create a password in order to create an account. You are solely responsible for maintaining the accuracy and privacy of your account information and for updating it as required.

3. PARTICIPATION AND BENEFITS

3.1 The Collector Club is a way in which we reward and thank our loyal customers for purchasing New Zealand Mint products and/or taking other Collector Club-related actions. Actions may require additional disclosures by you in order to qualify. You may earn Collector Club Credits (“Collector Credits”) for dollars you spend on each qualifying transaction on www.nzmint.com, excluding taxes, shipping charges, employee or other discounts, and items purchased with a gift card, merchandise credits, or any Rewards or other awards. Collector Credits will not be allocated to any Dropit reverse auction transactions. New Zealand Mint may also, at its sole discretion, provide additional Collector Credits in connection with certain transactions and promotions. In order for your eligible purchase or action to qualify for Collector Credits, you must be enrolled in the Collector Club, and you must be logged in to your account online prior to making such purchase or taking such action.

3.2 Collector Credits and Rewards earned through the Collector Club have no cash value, are non-negotiable, and cannot be redeemed either in whole or in part for cash. Only the Member paying for products in a qualifying purchase may accumulate Collector Credits or Rewards. If you return items from a qualifying purchase or obtain Collector Credits through fraudulent or other activity that violates these Collector Club Terms, the appropriate number of Collector Credits originally earned from such purchase or activity will be automatically deducted from your Member account balance. Collector Credits and Rewards do not constitute property of any Member or any other person and may not be brokered, bartered, pledged, gifted, sold, or otherwise transferred, other than by New Zealand Mint or as otherwise expressly provided for in these Collector Club Terms, and any receipt or use of Collector Credits or Rewards in violation of these Collector Club Terms will render such Collector Credits and Rewards void. Neither Accounts nor Collector Credits or Rewards may be shared or combined. Collector Credits earned may not be eligible for redemption until twenty-four (24) hours after they are awarded. Collector Credits are not capable of being combined or transferred to any other type of promotion or award. 

3.3 You can earn Collector Credits by making purchases on www.nzmint.com, except when purchasing via a Dropit reverse auction. For every US$1 you spend you will earn 2 Collector Credits. Currency exchange to USD is automatically applied to the value of your purchase for the purpose of determining how many Collector Credits you have earned.

New Zealand Mint may also offer Collector Club members access to special offers including early offers, extended offers or bonus Credits. These offers may be distributed by email. Special offers may be customized based on your purchase behaviours and preferences, or the opportunity to earn bonus Collector Credits. These offers are personal to you and cannot be shared, copied or transferred.

All special offers may have certain restrictions, including expiration dates and short, time-limited redemption periods. Read each offer carefully for specific details, expiration dates, and limitations and restrictions.

Taxes and fees, including without limitation, shipping and delivery fees, are excluded and ineligible for Collector Credit accrual.

3.4 If you have concerns that Collector Credits were not properly applied to your Member account, you should submit a request here. Your email must specify your name and email address associated with your account, the date of the purchase or action, and the issue(s) you encountered. This email must be sent within forty-five (45) days after the purchase or action took place. We are not responsible for late notifications regarding purchases or actions not being credited to a Member account.

3.5 You may redeem Collector Credits for eligible Rewards by signing into your account. Rewards may only be redeemed for New Zealand Mint products available on www.nzmint.com unless expressly authorized by New Zealand Mint. You cannot combine Rewards with any other coupon or promotion -  only one discount can be applied per order. For example, you can not use a Collector Club Reward and take advantage of a special offer discount at the same time. Rewards cannot be exchanged or returned for another product or service or a monetary refund. Collector Credits used to redeem a Reward will be deducted from the total Collector Credits available in your Member account. Collector Credits may not be used toward purchases of gift certificates, charitable items, promotional value sets, tax, or shipping charges. Credits from multiple accounts may not be aggregated. Taxes on Rewards may apply where required by law. You are solely responsible for any tax liability, including disclosure, related to your participation in the Collector Club, including upon receipt of Collector Credits or redemption of Rewards.

3.6 For information about how New Zealand Mint handles returns, please read our DELIVERY & RETURNS policy. Your Collector Credits balance may be impacted by returns as follows:

• If you void a purchase, New Zealand Mint will deduct the Collector Credits that you earned for that purchase, potentially resulting in a negative balance on your account.
• If you return merchandise, any Collector Credits used will be added back to your account once it has been received and verified at our Auckland office. New Zealand Mint may deduct any Collector Credits earned in connection with the purchase, potentially resulting in a negative Collector Credit balance.

3.7 Unless otherwise noted, Collector Credits are automatically added to your account following checkout and expire twelve (12) months after the calendar month in which such Collector Credits were earned, if there is no further activity on the account. For example, if you earn Collector Credits on December 15, 2020, they will expire on December 16, 2021. The oldest accrued Collector Credits will be used first for redemptions. You can view and track your balance and available rewards, as well as any additional benefits for which you are eligible as a Collector Club member, by logging in and using the Collector Club launcher on www.nzmint.com homepage.

3.8 New Zealand Mint reserves the right, at any time in its sole discretion and without notice to you, to change Rewards, how you earn Collector Credits, and how we evaluate and reward your eligible purchases and other Collector Club action.

4. COMMUNICATIONS

4.1 By joining the Collector Club, you will be automatically subscribed to receive, and you consent to receive Collector Club emails, including Collector Club marketing emails, from us and/or our partners. Such emails may include, but are not limited to, a Collector Club welcome email, redemption confirmation email, an account update email, or other communications that relate to your membership.

4.2 You may opt-out of the Collector Club at any time as set forth in Section 5.5 of these Collector Club Terms; however, you may still receive emails relating to your www.nzmint.com account, including marketing emails, from us pursuant to your www.nzmint.com subscription.

5. TERMINATION AND MODIFICATION

5.1 The Collector Club and its benefits are offered at New Zealand Mint’s sole discretion. We may, in our discretion, cancel, amend, modify, restrict, and/or terminate these Collector Club Terms and/or the Collector Club, or any aspect or feature of the Collector Club, at any time without prior notice, even if such changes may affect Collector Credits already earned and/or the value of Rewards already accumulated and/or the ability to earn Collector Credits and/or redeem Rewards.

5.2 Membership may be revoked by New Zealand Mint, in its sole discretion, at any time. Any abuse of the Collector Club; failure to follow any of these Collector Club Terms; membership inactivity for more than twelve (12) months; misrepresentation; or conduct that may be detrimental to New Zealand Mint or our interests may result in the revocation of your membership and make you ineligible for further participation in the Collector Club. If, in our sole discretion, we suspect fraud, misrepresentation, abuse, or violation of these Collector Club Terms, we also have the right to take appropriate legal action.

5.3 If New Zealand Mint terminates the Collector Club or your membership is revoked, any Collector Credits or Rewards in your account or available to you prior to such termination or revocation will automatically expire, and your access to the Collector Club and its features will automatically terminate, in New Zealand Mint’s sole discretion.

5.4 Qualifying purchases and actions, as reflected in New Zealand Mint’s records, shall be deemed correct, and New Zealand Mint reserves the right to determine the qualification for any transaction and to correct or modify the Reward at any time based on New Zealand Mint’s records and calculation of account information.

5.5 If you decide you no longer want to be part of the Collector Club, you may cancel your membership at any time by submitting a request here. Your email must specify your name and email address associated with your account and confirm that you wish to be removed from the Collector Club. It may take up to seven (7) business days for your cancellation to complete. You acknowledge and agree that, upon cancellation of your membership, you forfeit any Collector Credits you may have earned and/or any Rewards that might otherwise have been available to you during your continued participation in the Collector Club. If you wish to return to the Collector Club after cancelling your membership, you should contact New Zealand Mint here. You may be required to join the Collector Club again and start with no Collector Credits or available Rewards.

6. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

6.1 Neither New Zealand Mint nor its directors, employees, agents, partners, or licensors makes any representations or warranties of any kind whatsoever, express or implied, in connection with these Collector Club Terms or any of the Rewards associated therewith, including but not limited to warranties of merchantability, non-infringement, or fitness for a particular purpose. We make no warranties that defects or errors will be corrected.

6.2 You agree that neither New Zealand Mint nor its directors, employees, agents, partners, or licensors will be responsible for or liable (in contract, warranty, or in tort (including negligence)) for any (a) interruption of business; (b) access delays or access interruptions to the Collector Club; (c) data non-delivery, loss, theft, mis delivery, corruption, destruction, or other modification; (d) loss or damages of any sort incurred as a result of dealing the Collector Club site or on www.nzmint.com or use of any Reward of the Collector Club; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the Collector Club site or www.nzmint.com; (f) any inaccuracies or omissions in Collector Club content; or (g) events beyond our reasonable control, including without limitation any act of God, act of war, natural disaster, cyberattacks, terrorism, or any act or omission of a third party.

6.3 You agree that neither New Zealand Mint nor its directors, employees, agents, contractors, contractual partners, providers, or licensors shall be responsible to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other tangible losses (even if New Zealand Mint had been advised of the possibility of such damages), related to the Collector Club or your participation therein, whether in contract, warranty, or in tort (including negligence) even if New Zealand Mint has been advised of the possibility of such damages, and in no event shall New Zealand Mint’ maximum aggregate liability for such claims exceed one hundred dollars (US$100.00).

6.4 You further agree that no claims or action in contract, warranty, or in tort (including negligence) arising out of, or related to, your participation in the Collector Club, use of any Rewards or these Collector Club Terms may be brought by you more than one (1) year after the cause of action relating to such claim or action arose. If you are dissatisfied with the Collector Club, termination of your membership is your sole remedy. We have no other obligation, liability or responsibility to you.

7. INDEMNIFICATION

7.1 You agree to defend, indemnify and hold harmless New Zealand Mint, its directors, employees, agents, partners, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents from and against any and all liabilities, claims, actions, demands, damages, costs, losses and expenses (including reasonable attorneys’ fees) made by any third party due to or arising out of your participation in the Collector Club in violation of any law, rule, regulation, guideline, or these Collector Club Terms, and/or your violation of any rights of another.

8. CHOICE OF LAW AND DISPUTE RESOLUTION

8.1 The Collector Club and these Collector Club Terms are governed by New Zealand laws, without regard to its conflict of laws principles. You hereby consent to the exclusive jurisdiction and venue of the courts within Auckland, New Zealand, for any claims arising out of or relating to the Collector Club or your participation therein or the Collector Club site.

9. PRIVACY

9.1 The personal information collected from you in connection with the Collector Club, including but not limited to your Collector Club membership registration data and purchases made in connection with your Collector Club membership, is subject to our PRIVACY POLICY.
